What is a mis-sold timeshare claim?

The timeshare companies are ruthless and their products are very often marketed in such a way that in many cases such agreements are held in joint names meaning that both husband and wife are jointly and severally liable for any maintenance fees that accrue each year . Technically unless the timeshare operator ceases trading and fails to assign it’s clients then for many people the only way of exiting a timeshare has been to sell such timeshare , file for bankruptcy , death or just to stop paying the maintenance fees and hope for the best.
In June 2009 , Incentive Leisure was found guilty of 11 counts of fraud in respect of the selling of timeshares in an action brought against them by West Berkshire Trading Standards . Some of the more serious questions that Incentive Leisure faced was in respect of purporting to accept a clients existing timeshare in part exchange for one of their timeshare’s and the issuing of certificates whereby the client could claim up to 95% of the certificate value at some future date
The issuing of Reclaim certificates is a practice that is operated by a number of timeshare operators in mainland Spain , the Baleraic Islands and the Canary Islands in order to promote their timeshares . In many cases the face value of the certificate bears no relation to the price that was paid for the timeshare and in January 2011 a complaint was upheld by the Advertising Standards Authority that Reclaim Ltd could not substantiate that any customer had ever received 95% of the certificate value
